Updated University Compliance Directory - as at April 2024

The University’s Compliance Directory and Watchlist have been updated, with an as at date of April 2024. They are attached as PDF documents to this post.

The Directory lists all NSW and Cth laws applicable to the operations and activities of the University and its controlled entities. The Watchlist is for awareness purposes, which lists a variety of legislative instruments that are being monitored for potential/upcoming impact on University / controlled entity operations.

Action required:
1. Please review and note:
- Legislation on the Directory tagged as "Level A" must be complied with by ALL staff in all activities undertaken.
- Legislation on the Directory tagged as "Level A (Research)" must be complied with in all research-related activities including Research Institutes.

2. Notify the Compliance Program Unit at compliance@westernsydney.edu.au if you believe a law is missing or is incorrect or should be assigned to another unit for accountable operational compliance.

What’s notable?

The Modern Slavery Act 2018 (NSW) has been added as it recently imposes obligations for specific inclusions in the University’s annual report. This is on top of other annual reporting obligations, and modern slavery reporting under the Cth Act (already listed on the Directory).

The Crimes Legislation Amendment (Combatting Foreign Bribery) Act 2024 (Cth) has been added as a Watchlist item, where the amendment strengthens the legal framework for prosecuting foreign bribery offences and enforcing corporate criminal liability, relating to failing to prevent bribery of foreign public officials. This is expected to commence September 2024.
